1. About these terms
These terms are an agreement between you and [Company legal name] (“Watch Society”, “we”, “us”), of [Registered address]. They cover your use of the Watch Society website and any app we offer (the “service”).
By creating an account you agree to these terms, our Privacy Policy and the Odds disclosure. If you don't agree, please don't use the service.
2. Who can use the service
- You must be at least 18, or older where your state sets a higher age. We ask for your date of birth when you sign up.
- The service is for residents of the United States who are in the United States when they use it. Some states may be excluded; we'll tell you at sign-up if yours is. We may block access from outside the US.
- You may have one account. It's personal to you and can't be transferred.
- We verify your identity and age before your first deposit or withdrawal, using an identity verification provider. If we can't verify you, we may limit or close the account.
3. Your account
Keep your details accurate and up to date, including your date of birth, state and shipping addresses. Keep your password private; you're responsible for activity on your account. Tell us straight away through the help centre if you think someone else has used it.
4. Your wallet balance
Your wallet holds a balance in US dollars that you use to open boxes and pay for shipping. It is not a bank account: it earns no interest, it isn't a deposit with a bank and it isn't covered by FDIC insurance.
- You can add funds by card or Apple Pay, from $10 to $5,000 per deposit, subject to any limits you set yourself.
- Funds appear in your balance only once our payment processor has taken the payment.
- Every change to your balance is recorded in your transaction history with a reference (a deposit, a box opening, a sell-back, a shipping charge, a withdrawal or a reward). If we correct a balance by hand, the correction and its reason are recorded too.
- If a payment is reversed or charged back, we may deduct the amount from your balance and pause the account while we look into it.
5. Promotional credit and referrals
- Each promo code can be used once per account. Codes may expire or have other conditions shown with the code.
- Referrals: when a friend signs up with your link and opens a box of $50 or more, you get $25 and they get $25 in balance. A referral code must be claimed within 7 days of signing up.
- Promotional credit (from promo codes and referrals) can be spent on boxes but can't be withdrawn until it has been spent. When you open a box, promotional credit is used first.
- We may cancel promotional credit gained through multiple accounts, self-referrals or other misuse.
6. Boxes, odds and draws
- Each box shows its price, every item it can contain and each item's chance before you open it. The chances in a box add up to exactly 100%.
- A box's contents and odds belong to an edition. Odds never change while an edition is on sale; if we change the contents, we publish a new edition.
- The result is drawn on our servers with a provably fair method you can check yourself. The animation only shows the result the server already drew. See the Odds disclosure for the details.
- The box price is taken from your balance when you open it. Opening three at once costs three times the price and makes three independent draws.
- A box can be opened only while every item in it is in stock. Limited drops have a fixed quantity and a time window.
- Results are final. If a technical fault causes a wrong charge or result, we will put it right, which may mean reversing the opening and refunding the price.
7. Your items and the hold period
Each item is a real, authenticated piece kept in our insured vault. When you open a box, the item you receive is yours to keep, ship or sell back. Its estimated value is our current view of its market value, not a guarantee of what it would sell for elsewhere.
Items are graded for condition:
- Like new
- Excellent
- Good
Hold period. An item can stay in your collection for 30 days from the day you receive it. We'll remind you when 7 days are left. If you haven't asked us to ship it or sold it back by the end of the hold period, we will sell it back automatically at the buyback quote at that time and credit your balance.
8. Selling items back
While an item is in your collection you can sell it back to us for 90% of its estimated value, credited to your balance straight away. We show the exact amount before you confirm and check it again when you do; if the value has changed in between, we'll show you the new quote first. A sell-back can't be undone.
9. Shipping
- We ship to addresses in the United States only.
- Shipping is charged per shipment: Standard $25 (3–5 business days) or Express $45 (1–2 business days). Delivery times are estimates.
- Every shipment is insured. Insurance costs 1.2% of the declared value of the items in it.
- Sales tax is charged where it applies, based on the delivery state.
- Fees are paid from your balance and shown in full before you confirm. Once an item has been shipped it can no longer be sold back to us.
- Check your parcel on delivery and tell us within [number of days] if it arrives damaged or something is missing.
10. Withdrawals
- You can withdraw your balance to a verified US bank account. The minimum is $20. Promotional credit you haven't spent can't be withdrawn.
- You must have verified your identity first. Every withdrawal is reviewed by our team before it's paid; once approved, it usually arrives in 1–3 business days.
- We may delay or decline a withdrawal while we check for fraud, payment reversals or breaches of these terms, or where the law requires it. We'll tell you why where we're allowed to.
11. Responsible participation
Opening boxes should be fun, never a way to make money or solve money problems. In your profile you can:
- Set a monthly spend limit on box openings. Lowering it applies at once; raising or removing it takes effect after 24 hours.
- Take a break of 1 day, 7 days or 30 days.
- Self-exclude for 6 months, 12 months or 60 months. A self-exclusion can't be ended early.
During a break or self-exclusion, deposits, box openings and promo codes are paused. You can still ship or sell back items you already hold and withdraw your balance. If you're worried about your play, see responsible participation for support and [helpline details].
12. Acceptable use
You agree not to:
- open more than one account, or use someone else's account or payment method;
- use bots, scripts or other automated means to use the service;
- try to predict, influence or interfere with draws, or probe our systems;
- use the service for money laundering, fraud or any unlawful purpose;
- misuse promotions, referrals or chargebacks.
13. Suspension and closing your account
You can ask us to close your account at any time. We may suspend or close an account that breaks these terms, that we can't verify, or where the law requires it. When an account closes, we pay out any withdrawable balance to your verified bank account, subject to identity checks, and give you the chance to ship or sell back items you hold, unless the law prevents it.
14. Disclaimers and liability
[Disclaimer of warranties and limitation of liability, to be written by counsel]
Nothing in these terms limits rights you have under consumer protection law that can't be excluded.
15. Disputes and governing law
If something goes wrong, please contact us first through the help centre; most problems can be sorted out quickly.
These terms are governed by the laws of [Governing law state]. [Dispute resolution process, to be written by counsel]
16. Changes and contact
We may update these terms. If a change matters to you, we'll tell you by email or in the service before it takes effect. Changes never alter the odds of an edition already on sale.
